This course provides an overview of federal statutes and state-regulated areas that affect the personnel function. Among topics addressed are EEO and affirmative action, OSHA, ERISA, FMLA, and ADA; employee privacy issues (polygraph testing, drug and alcohol testing, employer searching and monitoring); and wrongful discharge.
This undergraduate course is 5 weeks.

- Research federal and state discrimination laws.
- Analyze federal and state discrimination laws related to unlawful discrimination.
- Apply federal and state laws to factual scenarios in order to recognize discriminatory practices.
- Distinguish between disparate treatment and disparate impact.
- Interpret principles of the Americans with Disabilities Act (ADA) and the ADA Amendment Act of 2008 ADAAA).
- Analyze situations in which reasonable accommodations are appropriate or inappropriate
- Recognize eligibility criteria for the Family Medical Leave Act (FMLA).
- Explore employment relationships, including principal-agency relationships, independent contractor, at-will employment, and non-compete contractual agreements.
- Examine exceptions to at-will employment.
- Explain employer liability for acts of employees and agents under the doctrine of Respondeat Superior.
- Evaluate legal responsibilities related to affirmative action.
- Assess potential “reverse discrimination” in the workplace.
- Assess corrective action measures utilized in progressive discipline.
- Evaluate provisions of major labor laws.
- Determine what constitutes unfair labor practices in relation to union and employer disputes.
- Describe the collective bargaining process.
